These Terms and Conditions (the “Terms”) govern your use of budbid.com and its language versions (the “Website”). They apply to everyone who visits the Website and, where indicated, set out additional terms for registered customers and for businesses that sell through the Website (“vendors”). Please read them carefully. By using the Website you agree to these Terms. If you do not agree, please do not use the Website.

1. Who we are

The Website is operated by R. Jones, trading as BudBid, 51 Bracken Road, Dublin, D18 CV48, Ireland (“BudBid”, “we”, “us”, “our”). You can contact us through our Contact page. For questions about personal data, email privacy@budbid.com.

2. What BudBid is, and what it is not

BudBid is an online marketplace and comparison website. It lets you discover and compare hemp-derived products, CBD products, cannabis seeds and related goods offered by independent vendors established in the European Union and elsewhere in Europe.

BudBid does not sell any products. When you click a button such as “Buy at …”, you leave the Website and go to the vendor’s own website. Any order you place there is a contract between you and that vendor only. BudBid is not a party to that contract and is not the seller, distributor, importer or agent of any vendor. The vendor alone is responsible for:

  • the products it sells, including their quality, safety, labelling and legal compliance;
  • its prices, taxes, delivery charges, delivery and returns;
  • taking payment, processing your order and handling your personal data on its website;
  • customer service, complaints, refunds and your statutory rights as a consumer, including your right of withdrawal under EU consumer law where it applies.

If you have a problem with an order, please contact the vendor directly. If you believe a vendor is acting unlawfully or misleading customers, please tell us through our Contact page or the “Report a problem with this listing” form on the product page.

3. Who may use the Website

The Website is intended only for adults. You must be at least 18 years old (or the legal age of majority where you live, if higher) to use it. By using the Website you confirm that you meet this requirement.

The laws on hemp, CBD and cannabis seeds differ between countries and can change. You are responsible for checking that buying, possessing and using any product is lawful where you live, and for complying with those laws. Listing a product on the Website does not mean that it is lawful to buy, import, possess or use it in your country.

4. Product listings, prices and availability

Product information on the Website, including names, descriptions, images, specifications, cannabinoid values, laboratory results, prices, pack sizes and stock status, is supplied by vendors or taken from their websites and product feeds. We work to keep it accurate and up to date. For example, we refresh prices from some vendors’ feeds daily. However, we do not verify every detail and cannot guarantee that listings are complete, accurate or current.

The vendor’s website is always the authoritative source. The price, availability and product details shown on the vendor’s website when you place your order are the ones that apply. Prices on BudBid are shown in euro and are provided for comparison only. They may not include delivery charges and may differ from the final price on the vendor’s website.

Product descriptions are provided for information only. Nothing on the Website is medical advice or a claim that any product can prevent, treat or cure any illness. Consult a healthcare professional before using CBD products, particularly if you are pregnant, breastfeeding, taking medication or have a medical condition.

Cannabis seeds are listed and sold for collection, preservation and other purposes permitted by law. Germinating cannabis seeds is illegal or restricted in many countries.

The order in which products appear may depend on factors such as relevance to your search, the filters and sorting you choose, how recently a product was added, and availability. Vendors cannot currently pay for higher placement. If this changes, we will label paid placements clearly.

5. How we make money: affiliate links

Using the Website is free for shoppers. BudBid is funded mainly through affiliate commissions: some links to vendors are affiliate links, and if you buy something after following one, the vendor pays us a commission. This never increases the price you pay. Affiliate links are labelled with a notice under the button on the product page. Affiliate links may pass through an affiliate network, such as Awin, before reaching the vendor’s website. More information about this is in our Datenschutzerklärung.

Commission arrangements do not affect which products we list or how prices are shown. Listings are not reviews or recommendations by BudBid.

6. Customer accounts

You can browse the Website without an account. If you create one, you must give accurate information, keep your password secure and tell us promptly if you think someone else has accessed your account. You are responsible for activity on your account. You can ask us to close your account at any time.

7. Acceptable use

When using the Website, you must not:

  • break any law, or use the Website for any fraudulent or harmful purpose;
  • impersonate any person or business, or give false information;
  • send spam, unsolicited advertising or malicious code, or try to gain unauthorised access to the Website, its servers or its data;
  • scrape, copy or extract content or data from the Website by automated means (including bots, crawlers and scrapers), except for search engines indexing public pages in line with our robots.txt file;
  • interfere with the proper working of the Website, including by overloading it or generating artificial clicks or traffic;
  • use the Website to arrange the sale or supply of products that are illegal in the EU or in the relevant country.

We may suspend or block access to the Website, or close accounts, where we reasonably believe these Terms have been breached.

8. Additional terms for vendors

This section applies to businesses that register as vendors, or whose products we list with their permission. If there is a conflict between this section and the rest of these Terms, this section applies to vendors.

8.1 Registration and approval

You must register as a vendor through the Website and give complete and accurate information, including your business name, address, contact details and, where applicable, VAT and company registration numbers. You must only register on behalf of a business that you are authorised to represent. Vendors must act as traders (not consumers) when using the Website.

All vendor registrations are reviewed before a store becomes visible. We may ask for further information to verify your business, and we may refuse or withdraw approval at our discretion, for example where we cannot verify your identity, where your products do not appear to be lawful, or where your registration shows signs of fraud.

8.2 Your legal obligations as a seller

You are solely responsible for complying with all laws that apply to your business and products in every country where you sell, including laws on hemp, CBD, novel foods, cosmetics, tobacco and smoking products, seeds, product safety, labelling, advertising, distance selling, consumer rights, data protection, tax and age verification. You must display the trader information that EU law requires, both on your BudBid store page and on your own website.

8.3 Listing rules and prohibited products

You must ensure that your listings are accurate, lawful and not misleading, and that you have all rights needed to use the text, images and other content they contain. You must not list, and we will remove:

  • products that are illegal to sell in the European Union, or in the countries you ship to, including products whose THC content exceeds the legal limits that apply to them;
  • synthetic or semi-synthetic cannabinoids (such as HHC and its derivatives) and other substances that are banned or restricted, wherever this applies;
  • products with medical or health claims that are not permitted by law;
  • counterfeit products, or products that infringe someone else’s intellectual property;
  • products aimed at or appealing to minors;
  • any other product or content that we consider unsuitable for the Website.

We may edit listings to correct obvious errors, translate them, standardise formatting or add category and filter information. Where we copy or translate content from your website, you remain responsible for its accuracy.

8.4 Fees

Registering and listing products on BudBid is free. There are no monthly fees and we charge no commission on your sales.

If you choose our optional listing upload service, we copy your product listings, descriptions, images and attributes from your website to your BudBid store for a one-off fee of €20 per 50 products, or part of 50 (for example, €20 for up to 50 products, €40 for 51 to 100 products). We will confirm the number of products and the fee before starting. Fees are invoiced and payable within 14 days unless we agree otherwise. Fees are stated exclusive of any VAT that may apply.

8.5 Licence to use your content

You grant BudBid a non-exclusive, royalty-free, worldwide licence, for as long as your products are listed and for a reasonable period afterwards, to use, reproduce, adapt, translate, display and publish your business name, logos, product information and images on the Website and in related promotion (for example, in search results, social media and advertising for the Website). You confirm that you have the right to grant this licence.

8.6 Links to your website and affiliate programmes

Product listings link to the corresponding pages of your website. If you run an affiliate programme, directly or through an affiliate network, we may join it and use affiliate links for your products in line with its terms. You may not require shoppers to complete their purchase through any channel other than your own website.

8.7 Suspension, removal and ending

You may ask us to remove your listings or close your vendor account at any time. We may suspend or remove any listing or vendor account, with or without notice, where we reasonably believe that these Terms or the law have been breached, where we receive a credible complaint, or where this is needed to protect shoppers or the Website. Where this does not prejudice an investigation or legal obligation, we will tell you the reasons.

8.8 Your responsibility to us

You will indemnify BudBid against all losses, damages, fines, costs and expenses (including reasonable legal fees) arising from your products, your listings, your breach of these Terms, or your breach of any law or third-party right.

9. Intellectual property

The Website, its design, software, the BudBid name and logo, and content created by BudBid are owned by or licensed to BudBid and are protected by intellectual property laws. Vendor names, logos, product names and product content belong to the relevant vendors or other owners. You may view and print pages for your own personal, non-commercial use. You must not otherwise copy, reproduce, distribute or create derivative works from the Website without our written permission.

10. Links to other websites

The Website contains links to vendors’ websites, affiliate networks and other third-party websites. We do not control those websites and are not responsible for their content, products, services, availability or privacy practices. Visiting them is at your own risk and subject to their terms.

11. Availability of the Website

We aim to keep the Website available and working properly but cannot guarantee that it will always be available, uninterrupted or free from errors. We may change, suspend or withdraw any part of the Website at any time, for example for maintenance or security reasons.

12. Our liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law. If you are a consumer, nothing in these Terms affects your statutory rights, including your rights against vendors under EU and national consumer law.

The Website is provided free of charge to shoppers to help them find and compare products. As we are not the seller, we are not liable for any product bought from a vendor, for any act or omission of a vendor, or for any contract between you and a vendor.

Subject to the paragraphs above, we are not liable for any loss or damage caused by inaccurate listing information supplied by vendors, by temporary unavailability of the Website, or by viruses or other harmful material that may infect your device, where we have taken reasonable care. For business users, including vendors, our total liability arising out of or in connection with these Terms is limited to the greater of €100 and the fees you paid us in the 12 months before the claim, and we are not liable for any loss of profit, revenue, business or goodwill, or any indirect or consequential loss.

13. Privacy

Our Datenschutzerklärung explains how we collect and use personal data, the cookies we use, and the rights you have. It forms part of these Terms.

14. Complaints

If you have a complaint about the Website or about BudBid, please contact us through our Contact page. We will acknowledge your complaint promptly and aim to resolve it within 30 days. Complaints about a product, order, delivery or refund should be sent to the vendor concerned.

15. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to the Website or to the law. The “Last updated” date at the top shows when they were last changed. Changes apply from the date they are published. Where changes significantly affect registered vendors, we will give at least 15 days’ notice by email before they take effect.

16. General

If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will continue to apply. If we do not enforce a right straight away, we can still enforce it later. These Terms are the entire agreement between you and us about your use of the Website. We may transfer our rights and obligations under these Terms to another organisation. You may not transfer yours without our written consent.

These Terms are available in English. Where we provide translations, the English version prevails in case of any difference, to the extent permitted by law.

17. Governing law and jurisdiction

These Terms are governed by the laws of Ireland. If you are a consumer, you will also benefit from any mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of Ireland or of your country of residence. If you are a business, the courts of Ireland have exclusive jurisdiction.
